Domain Name and Hosting Contract
This Agreement is dated and in effect as

Between (Web designer) and (Client).
This agreement is with respect to the domain name registration of xxx website name.com website.

As consideration for the Services, Client agrees to
pay to Web designer all applicable fees as specified
for the service package indicated. All fees payable
hereunder are non-refundable.
Abuse through content
Web designer is only responsible for the technical
development of the website and the client must
provide all content materials. Client agree that he
will not post any material which is false,
defamatory, inaccurate, abusive, vulgar, hateful,
harassing, obscene, profane, threatening, invasive
of a person's privacy, or otherwise in violation of
ANY law.
Limitation of liability
The Client agrees that they are not using, nor
intending to use, their website to conduct business
illegally in any way or perform activities that
violate their state, federal, local, or
international laws. Web designer cannot be held
liable for any legal issues the client encounters
from misuse of their website.
Web designer will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the Web site.
In purchasing domain names on behalf of the client, Web designer is acting solely as the client’s agent and accepts no responsibility for legal issues the client encounters from the misuse of their domain. All domain renewal fees must be paid by the client after the first year of service.
Domain name registered by Web designer is to keep the client personal information anonymous (such as his/her full name, address, phone number, credit card number). Updating domain name registration information or moving domain from an account to another account, the client must pay a $120 fee.
Web designer is not responsible to determine whether the domain name Client selects or the use Client or others make of the domain name(s), or other use of the Services, infringes legal rights of others. It is Client responsibility to know whether or not the domain name(s) Client selects or use or allow others to use infringe legal rights of others.
Web designer might be ordered by a court or arbitrator to cancel, modify, or transfer your domain name. It is not Web designer responsibility to forward court orders or other communications to Client. Web designer policy is to comply with court orders from courts of competent jurisdiction as well as UDRP Panel decisions. If Client contacts Web designer informing that Client is contesting a court order from a court of competent jurisdiction, we may, but are not obligated to, place a transfer lock on the domain name pending the outcome of the dispute. Web designer will not delay implementation of a UDRP Panel decision based solely on your informing us that you intend to contest the decision.
Copyrights and Trade marks
Client unconditionally guarantees that any elements
of text, graphics, photos, designs, trademarks, or
other artwork furnished to Web designer for
inclusion in the Project are owned by Client, or
that Client has permission from the rightful owner
to use each of these elements, and will hold
harmless, protect, indemnify and defend Web designer
from any liability (including legal fees and court
costs), including any claim or suit, threatened or
actual, arising from the use of such elements
furnished by Client.
RENEWALS AND FORFEITURE
Domain names are registered for a finite period of time. In the event that Client fail to renew your domain name in a timely fashion, the registration will expire and we may, at our discretion, elect to assume the registration and may hold it for our own account, delete it or we may sell it to a third party. Client acknowledges and agrees that his right and interest in a domain name ceases upon its expiration and that any expired domain name may be made available for registration by a third party.
If Client fails to renew the registration, Client
domain name may cease to resolve and visitors to
Client site may be redirected to a default page
informing them that the site is no longer in
service. This parked or default page may feature
advertisements posted by Web designer for our own
account.
If Web designer, in his sole discretion, has elected
to renew the registration. Additional costs for the redemption and
re-registration will apply. The domain name also may be listed for
auction and promoted as being available for auction.
If the name is sold during any such auction, it will
be acquired by a third party and will not remain
available for re-registration by you after our
stated grace period. If Client does not re-register
the domain name during the grace period, the auction
sale will be concluded and ownership of the domain
transferred to a third party.
If Client fail to renew domain name
registration during the grace period, Client
acknowledge that he has abandoned the domain name
and that it is available for sale and registration
by any third party.
MODIFICATIONS TO AGREEMENT
Client agrees, during the period of this Agreement, that we may: (1) revise the terms and conditions of this Agreement; and (2) change the service provided under this Agreement. Any such revision or change will be binding and effective immediately on posting of the revised Agreement or change to the service on our web site, or on notification to you by e-mail or regular mail as per the Notices section of this agreement. Client agrees to review our web site, including the Agreement, periodically to be aware of any such revisions.
ACCEPTANCE OF AGREEMENT. CLIENT ACKNOWLEDGE THAT HE HAS READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. CLIENT HAS INDEPENDENTLY EVALUATED THE DESIRABILITY OF THE SERVICE AND ARE NOT RELYING ON ANY REPRESENTATION AGREEMENT, GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.
